Taking control of goods (fees) regulations 2014

The Taking Control of Goods (Fees) Regulations 2014 introduced a new fee structure to the enforcement industry. The new fee scale was introduced to replace the previously multiple fee structures used by bailiffs. Further information on the new fee scale can be found in Bailiff Fees. Here’s a quick overview of the new fees. It’s important to note that these fees still apply to debts incurred before 6th April 2014.

HCEOs may charge a fee for the service they provide under the Taking Control of Goods Act. The regulation sets out a range of fees that the agency may charge for the enforcement of a judgment. Fees begin at PS75, which is charged once notice of enforcement is served. If the debtor breaches the CGA, the enforcement agent can charge a fee equivalent to the VAT on the enforcement agent’s fees. This fee will rise every time the debtor fails to comply with the CGA.

Bailiffs can seize items from your home to cover debt

You can avoid being arrested by bailiffs by paying your debt. You should get legal advice before cooperating with a bailiff. The bailiff may seize your belongings or use force to enter your home. However, it’s best to comply with a bailiff’s request because refusing to do so may result in court action. In addition to contacting the creditor, you may be asked to provide proof that you paid the debt. Otherwise, you’ll have to deal with bailiffs resuming their search. If the bailiffs take possession of your belongings, you can ask them to sell them off and pay off your debt.

If you are a sole trader, you should consider what a bailiff may take. For a sole trader, business debts are treated as personal debts. Generally, bailiffs are permitted to seize household goods or items that are owned jointly. Some of these items are even on hire-purchase. But, there are exceptions to this rule. Items belonging to your children or other family members cannot be seized. In addition, bailiffs are also allowed to seize items you’ve gotten a hold of, such as jewellery.
